Terms and Conditions

These Terms of Use were last updated on December 28, 2018.

The mission of WiFi Mentor is to provide universal access to the best health education of today. Consequently, improving hundreds of thousands of lives of people around the world through this accessible education. Many people suffer unnecessarily from various health problems and pain because of a lack of self-management skills or because they cannot find the right therapist. We want to contribute to a better world spreading knowledge.
To reach this goal we: 1 – teach simple ways to improve people’s health; 2 – teach evidence-based techniques to health care providers, who in turn will help their patients to heal better and faster. We only admit renowned professors with vast clinical, scientific and didactic experience. Teachers need to agree to the Instructor Agreement as well.

These Terms of Use rule your use of WiFi Mentor’s website, applications, and other products and services as well. Because some of our Services may involve downloading software to your computer, phone, tablet, or another device, you agree that we may automatically update this software and these Terms will apply to such updates. Please read these Terms thoughtfully, and reach us if you have any inquiries. By using our Services, you agree to be tied and secured by these Terms.

1. Definitions

“Online Course” means a distance learning course taught through videos that are accessed through our educational remote access (internet) platform.

“Services” means the provision of the Online Course, book and/or certificate as agreed, selected and purchased in our online store.

“Website” means www.wifimentor.com.

“You” means the individual who purchases the Services.

“We” means the company providing the Services, based in São Paulo/Brazil, registered under No. 21.143.689/0001-83

2. Accounts

You must have an account for almost everything on WiFi Mentor’s platform. Keep your password safe. Remember you are accountable for all activities connected with your account. If you believe another person is using your account, please contact us immediately. If you did not reach the age of consent for online services in your country, you might not open an account. If this is the case, we encourage you to invite a parent or guardian to set up an account and assist you to enroll in courses that are suitable for you. If we find that you have created an account and you are under the age required to consent to the use of online services, we will cancel your account.

With your account, you can buy and sign up for a course. When setting up and managing your account, you must present and keep providing correct and complete information, including your full correct name, which will appear on your certificate, and a valid email address. You have full responsibility for your account and everything that happens in your account, including any injury or loss (us or anyone else) caused by someone utilizing your account with or without your consent. This implies you must be cautious with your password. You may not transfer your account to another person or use someone else’s account. If you contact us to request access to an account, we will not give access to you until you can present the login credential information for that account. In the case of the death of a user, that user’s account will be closed.

If you share your login information with someone else, you are responsible for what occurs to your account, and WiFi Mentor will not mediate disputes between students or instructors who have shared login credentials. You need to inform us promptly when you know that someone may be using your account without your approval (or if you presume any other breach of security). We may ask some of your personal data to confirm that you are, in fact, the owner of your account.

3. Course registration and access

When you sign up for a course, you obtain a license from us to view it through the WiFi Mentor Services exclusively. It is strictly forbidden to transfer or resell courses in any way. We grant you a valid access license for 1 year, which may be interrupted in exceptional cases.

Instructors grant WiFi Mentor a license (Instructor Agreement) to offer this course to students. This means that we have the right to sublicense the course for students who enroll in the course. When you sign up for a course you get from WiFi Mentor a license to view the course through the WiFi Mentor platform and Services. Courses are licensed and not sold to you. This license does not give you the right to resell the course in any way (including by sharing account information with a buyer or illegally downloading the course and sharing it on torrent sites, for example).

In legal terms, WiFi Mentor grants you (as a student) a limited, non-exclusive, non-transferable license to access and view the courses and associated content for which you have paid all fees, only for your personal non-commercial, educational purposes. All other uses are expressly prohibited. You may not reproduce, redistribute, transmit, assign, sell, transmit, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any course unless we grant you permission explicitly in a written agreement signed by an authorized representative of WiFi Mentor.

The access license for our students is valid for one year when they enroll in a course. However, we reserve the right to cancel any license to access and use courses at any time in case we decide or are required to disable access to a course due to legal or policy reasons. For example, if the course you signed in is the subject of a copyright complaint, or if we determine that its content violates our Trust and Security Guidelines.
Instructors cannot grant licenses to their courses directly to students and any such direct license shall be null and void and a breach of these Terms.

4. Payments, Credits, and Refunds
4.1 Prices
Our prices may change due to promotions and sales for our courses. The price applicable to a course will be the price at the time you finish the course purchase (at checkout). Any price offered for a particular course can also vary when you are logged into your account from the price available to users who are not registered or logged in because some of our promotions are only accessible to new users.
In some countries, the price you see may include local legal taxes when applicable.

4.2 Payments

You agree to pay the fees for courses that you buy, and you authorize us to charge your debit or credit card or to process other means of payment for those fees. WiFi Mentor works with third-party payment processing partners to offer you the most convenient payment methods in your country and to keep your payment information safe. Check out our Privacy Policy for more details.

When you purchase, you accept to use a valid and authorized payment method. If your method of payment fails and you still have access to the course you are applying to, you accept to pay us the corresponding fees within thirty (30) days of our notification. We have the right to disable access to any course for which we have not received payment.

4.3 Other paid Services

WIFi Mentor may offer other paid Services in addition to the course itself for a fee. You are responsible for paying all applicable fees and taxes promptly with a payment mechanism associated with the appropriate paid Services. If your form of payment fails or your account is expired, we may charge you fees using other collection mechanisms. Rates may vary based on your location and other factors, and WiFi Mentor reserves the right to change any fees at any time in its sole discretion. Any change, update or modification will take effect immediately upon posting through the related Services.

4.4 Refunds and Credits

If the course you purchased is not what you expected, you can request, within five days of your purchase of the course, that WiFi Mentor credits or refunds your account. We reserve the right to apply a credit or refund at our discretion depending on the capabilities of our payment processing partners or the platform on which you purchased your course. No credit or refund is due to you if you request after the 5-day warranty limit.

At our discretion, if we understand you are abusing our credit/refund policy, we possess the right to ban your account and restrict all future use of the Services. If we ban your account or disable your access to a course due to your violation of these Terms or our Trust and Security Guidelines, you may not receive credit or refund.

5. Content and Behavior Rules

You can only use WiFi Mentor for lawful purposes. You are responsible for all the content that you post on our platform. You must keep comments, reviews, questions, posts, courses and other content submitted under our Trust and Safety Guidelines and the law, and respect the intellectual property rights of others. We may ban your account for severe or repeated offenses. If you believe someone is violating your copyright on our platform, let us know.

Your use of the Services and behavior on our platform must be in accordance with applicable local or national laws or regulations of your country. You are solely responsible for the knowledge and compliance with such laws and regulations that apply to you.

Above all, no matter the law of the country where you reside, it is strictly forbidden to use our Services to share or promote content that:
(a) Contains illegal content or supports illicit activities.
(b) Includes credible threats or organize acts of violence.
(c) Contains any type of harassment.
(d) Infringes intellectual property, privacy or other rights. Do not share content that you do not have the right to share. Always assign materials used or cited by you to the original copyright owner.
(e) Contains advertising, promotional or solicitation content. In other words, it is forbidden to do Spam.
(f) Supports or helps someone to do any of the things on this list.

Additionally, no matter the law of the country where you reside, it is strictly forbidden to use our Services to:
(a) Reproduce, transfer, sell, resell or otherwise misuse any Content of our Services unless specifically authorized to do so.
(b) Use our services to distribute malware.
(c) Do anything that violates local, state, national or international law.
(d) Share your password, let another person access your account, or do anything that put your account at risk.
(e) Attempt to access any other user’s account.
(f) Access or use non-public areas of our systems unless specifically authorized to do so.
(g) Break or bypass our authentication or safety measures unless specifically allowed to do so.
(h) Try to reverse engineer any part of our Services.
(e) Try to interfere with any user, host, or network, for example by sending a virus, overloading, spamming, or mail-bombing.

WiFi Mentor has the right to enforce these Terms and our Trust and Security Guidelines. We may terminate or suspend your permission to use our platform and Services or terminate your account at any time, with or without notice, for any breach of these terms, including:
(a) If you fail to pay any fees when due.
(b) By law enforcement or government agencies.
(c) For long periods of inactivity.
(d) For technical problems or unexpected problems.
(e) If we suspect you to engage in fraudulent or illegal activities.
Your content may still be available on the platforms even if your account is closed or suspended. You agree that we will have no liability to you or any third party for banning your account, removing your content or blocking your access to our platforms and services.

If one of our instructors has posted a course that violates your copyright or trademark, please let us know.

6. WiFi Mentor rights to the content you post

The content you post as a student or instructor (including courses) remains your own. By posting courses and other content, you allow WiFi Mentor to reuse and share with anyone through any media, including promoting it through advertising on other websites, but you do not lose any ownership rights you may have about your content.

In other words, by submitting or posting content on or through the platforms, you grant us a worldwide, non-exclusive and royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, transmit, publish, display and distribute your content on any and all media or distribution methods (existing right now or subsequently developed). This includes making your content accessible to other companies, organizations, or individuals who partner with WiFi mentor to distribute, broadcast, disseminate, or publish content in other media. You represent and warrant that you have all necessary rights, power, and authority to allow us to use any content you submit. You also agree to all such uses of your content without any payment to you.

7. Using WiFi Mentor at your own risk

By using the Services, you may be exposed to content that you consider offensive, immoral or unacceptable. WiFi Mentor has no responsibility to keep such content from you and no responsibility for your access or enrollment in any course, to the extent permitted by applicable law. This also applies to any course related to health, wellness, and physical exercise. You acknowledge the risks and dangers inherent in the strenuous nature of these types of courses, and by enrolling in these courses, you choose to take such risks voluntarily, including risk of illness, bodily injury, disability or death. If you apply the techniques and teachings to someone, the risks or consequences to this person as a result of this practice will be your sole responsibility.

In other words, YOU ASSUME FULL RESPONSIBILITY AND RISK OF LOSS RESULTING FROM USE OF THE WIFI MENTOR WEBSITE AND ANY INFORMATION ON THE WIFI MENTOR WEBSITE. WIFI MENTOR MAKES NO GUARANTEES ABOUT THE SUITABILITY OF ANY INFORMATION AND ITS SERVICES FOR ANY PURPOSE WHATSOEVER. WIFI MENTOR MAY PROVIDE PROGRAMS WITH EXERCISES RELATED TO YOUR CONDITION THAT YOU CAN PERFORM AT HOME. AS THERE IS A RISK OF INJURY WITH ANY ACTIVITY, USE CAUTION WHEN PERFORMING SUCH EXERCISES. IF YOU EXPERIENCE PAIN OR DISCOMFORT, IMMEDIATELY DISCOUNTINUE THE EXERCISES AND CONTACT YOUR CLINICIAN OR PHYSICIAN. BY VOLUNTARILY UNDERTAKING ANY EXERCISE IN A PROGRAM PROVIDED BY WIFI MENTOR, YOU AGREE THAT YOU ASSUME THE RISK OF ANY RESULTING INJURY. WIFI MENTOR WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES OR LOSSES THAT MAY RESULT. THE INFORMATION AND CONTENT PROVIDED IN THIS COURSE ARE FOR INFORMATIONAL PURPOSES ONLY. WIFI MENTOR MAKES NO WARRANTIES REGARDING, AND BEARS NO LIABILITY FOR, YOUR USE OF THE INFORMATION AND CONTENT. NEITHER WIFI MENTOR NOR THE INSTRUCTOR ASSUMES ANY RESPONSIBILITY FOR ANY LOSS OR INJURY AND/OR DAMAGE TO PERSONS OR PROPERTY ARISING OUT OF THE USE OF THE MATERIAL CONTAINED IN OR RELATED TO THE ONLINE COURSE. IT IS THE RESPONSIBILITY OF THE TREATING PRACTITIONER, RELYING ON INDEPENDENT EXPERTISE AND KNOWLEDGE OF THE PATIENT, TO DETERMINE THE BEST TREATMENT AND METHOD OF APPLICATION FOR THE PATIENT.

The same rule applies for business, administration or investment courses. WiFi Mentor is not responsible for any financial loss due to the application of any teaching. You assume full responsibility for the decisions made before, during and after your registration in a course.

When you communicate directly with a student or instructor, you should be cautious about the private information you share. We do not control what students and instructors do with data received from other users on the platform. You should not share your email or additional personal information about yourself for your protection.

We do not hire or employ instructors. Neither we are responsible for any communications between instructors and students. We are not responsible for disputes, claims, losses, injuries or damages of any kind that may arise or be related to the conduct of instructors or students.

When you use our Services, you will find links to other websites that we do not own or control. We are not responsible for the content or any other aspect of these third party sites, including their collecting information about you.

8. WiFi Mentor’s Rights

We own the WiFi Mentor platform and Services. The WiFi Mentor platform, website, title, existing or future applications and services, our logos, APIs, databases, codes, and content created by our employees or partners submit or provide through our Services are and will remain the exclusive property of WiFi Mentor and its licensors. The only exception is the content provided by instructors and students. You can not tamper with any of our properties or use them without permission. The same applies to the content produced by instructors and students.

Our platforms and services are protected by copyrights, trademark, and other laws. Nothing provides you the right to use the WiFi Mentor name or any of the WiFi Mentor trademarks, logos, domain names, and other distinctive features of the WiFi Mentor brand. Any comments, feedback or suggestions you give us about WiFi Mentor or our Services are spontaneous, and we will be free to use them as we understand and without any obligation to you.

You cannot do any of the following when accessing or utilizing the WiFi Mentor platform and Services:
(a) access, tamper with or use non-public areas of the platform, WiFi Mentor’s computer systems, or the technical delivery systems of WiFi Mentor service providers.
(b) disabling, interfere with, or attempting to bypass any of the features of the platform related to security or probe, scan or test the vulnerability of any of our systems.
(c) copy, modify, create derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code of or content on the WiFi Mentor platform or Services.
(d) access, search or attempt to access or search our platform by any means (automated or otherwise) other than through our currently available search functionalities provided through our website, mobile apps, or API.
(e) use our services to send altered, misleading, or false source-identifying information (such as sending email communications falsely appearing as WiFi Mentor); or interfere with, or interrupt (or attempt to do so) the access of any user, host or network, including, but not limited to: sending a virus and sending spam.

9. Miscellaneous Legal Terms
9.1 Binding Agreement

You agree that by registering, accessing or using our Services, you fully agree to enter into a legally binding contract with WiFi Mentor. If you do not accept these Terms, do not register, access or use any of our Services.

These Terms (including any agreements and policies bound by these Terms) establish the whole agreement between you and us (you must include the Instructor Agreement if you are an instructor of one of our courses).

If any part of these Terms is held to be invalid or unenforceable under applicable law, that provision shall be deemed superseded by a valid and enforceable provision that best corresponds to the intent of the original provision and the remainder of these Terms shall remain in full force and effect.

Even if we are behind in exercising our rights or fail to use a right in one case or a particular instance, that does not imply that we abandon our rights under these Terms, and we may choose to apply them in general or in the future.

The following sections will survive the expiration or termination of these Terms: Sections 3 (Course Enrollment and Access), 6 (WiFi Mentor Rights to Content You Publish), 7 (Using WiFi Mentor at Your Own Risk), 8 (WiFi Mentor Rights), 9 (Miscellaneous Legal Terms) and 10 (Dispute Resolution).

9.2 Disclaimers

We will take all commercially reasonable steps to provide uninterrupted access to the Services. However, your access may be restricted from time to time for reasons beyond our control. Such reasons include events of force majeure; power outages; an act of war, hostility or sabotage; natural disaster; electrical, internet or telecommunication failure; or government restrictions; and actions from computer hackers and others acting outside the law. Your access may also be interrupted due to software problems, server downtime, increased Internet traffic, programming errors, regular maintenance, and other related reasons. These are just examples. You agree that you will not have any recourse against us in any of these cases where any of our Services is not functioning as it should. In legal, complete language, the Services, and their content are provided on an “as is” and “as available” basis. We (and our affiliates, suppliers, partners, and agents) make no representations or warranties about the suitability, reliability, availability, timeliness, safety, lack of errors or accuracy of the Services or their content, and expressly disclaim any warranties or conditions. (express or implied), including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We (and our affiliates, suppliers, partners, and agents) do not guarantee that you will obtain specific results from the use of our services. Your use of the Services (including any content) is entirely at your own risk.

While we take pride in our world-class courses, unexpected events occur. WiFi Mentor reserves the right to cancel, interrupt or reschedule any course or to modify any course content or the point value or form of evaluation and scoring of any task, test or another type of examination. We may decide to discontinue the availability of certain features of the Services at any time and for any reason. Under no circumstances will WiFi Mentor or its affiliates, suppliers, partners or agents be held liable for any damages due to such interruptions or unavailability of such features.

9.3 Limitation of Liability

There are risks inherent in using our Services, for example, if you enroll in a course related to health, wellness and physical exercises and you injure yourself. Alternatively, learn a massage technique (for example) and hurt someone while applying it. You fully accept these risks, and you agree that you will have no recourse to seek damages against even if you suffer loss or damage from using our platform and Services or if others suffer loss or injury based on a practice you learned with us. In legal language, to the fullest extent permitted by law, we (and the companies in our group, suppliers, partners and agents) will not be liable for any indirect, incidental, punitive or consequential damages (including loss of data, revenue, profits, or business opportunities, or personal injury or death), whether arising in contract, warranty, tort, product liability or otherwise, and even if we have been advised of the possibility of damages in advance. Our liability (and the liability of each of our group companies, suppliers, partners and agents) to you or any third party under any circumstance is limited to a maximum of one hundred dollars ($100) or the amount you have paid us in the twelve (12) months before the event giving rise to your claims.

9.4 Indemnification

If you behave in a way that puts us in legal trouble, we can legally appeal against you. You agree to indemnify, defend (if we so request), and hold harmless WiFi Mentor, the companies of our group and their officers, directors, suppliers, partners and agents from any third-party claims, demands, losses, damages, or expenses (including fair lawyer fees) arising from (a) the content you post or upload, (b) your use or attempted use of the Services (c) your violation of these Terms, (d) your violation of any law or third party rights, or (e) your violation of the content of users and instruments, including, without limitation, any claim of infringement or misappropriation of intellectual property or other proprietary rights. Your indemnity obligation will survive termination of these Terms and your use of the Services.

9.5 Governing Law and Jurisdiction

These Terms are governed by the laws of Brazil, without reference to your choice or conflicts of law principles. You and we agree that any dispute relating to these Terms shall be governed by Brazilian law. You also agree that the city of São Paulo, SP – Brazil is the legal forum for any dispute.

9.6 Legal actions and notices

No action, regardless of form, arising out of or relating to this Agreement may be brought by either party more than one (1) year after completion of the cause.
Any notice or other communication related to the Terms must be sent by email (by us to the email associated with your account or by you to info@ wifimentor.com.br).

9.7 Relationship Between Us

You and we agree that there is no joint venture, partnership, employment, contractor or agency relationship between us.

Nothing in these Terms or otherwise with respect to your participation in any course: (a) establishes any relationship between you and any educational institution with which WiFi Mentor may be affiliated; (b) enrolls or registers you in any educational institution, or in any course offered by an educational institution; or (c) entitles you to use the resources of any educational institution beyond participation in the course.

9.8 Non-transfer

You may not assign or transfer these terms (or the rights and licenses granted under them). Nothing in these Terms confers any right, benefit or remedy on any third-party person or entity. You agree that your account is non-transferable under any circumstances. In the event of the death, the account is terminated.

9.9 Academic Credits

Unless otherwise explicitly indicated by a credit-granting institution, participation in or completion of a course does not confer any academic credit. Even if credit is awarded by one institution, there is no presumption that other institutions will accept that credit. You agree not to receive credit for completing a course unless you have earned a Course Certificate (or other equivalent WiFi Mentor credential) for that course. WiFi Mentor, the course instructors, and the associated participating institutions have no obligation to have a course recognized by any educational institution or accreditation organization.

9.10 Security

We care about the security of our users. While we work to preserve the security of your account and related information, WiFi Mentor cannot ensure that unauthorized third parties will not be able to defeat our security measures. Please inform us promptly of any compromise or unauthorized use of your account by emailing info@wifimentor.com.br.

9.11 Educational Research

WiFi Mentor is committed to improving the science of education and teaching, and records of your participation in courses may be used for education research. In the interest of this research, you may be exposed to variations in the course content. Research findings will typically be reported at the aggregate level. Your identity will not be publicly exposed in any research findings without your express approval.

10. Dispute Resolution

If there’s a dispute, our Support Team is happy to help resolve the issue. Always before submitting a formal legal case, try contacting our support team first. If this does not work the forum to resolve the dispute legally is the city of São Paulo – SP, Brazil.

10.1 No Class Actions

We both agree that we can each only bring claims against the other on a personal basis. This means: (a) neither of us can bring a claim as a plaintiff or class member in a class action, consolidated action, or representative action; (b) an arbitrator can’t combine multiple people’s claims into a single case (or preside over any consolidated, class, or representative action); and (c) an arbitrator’s decision or award in one person’s case can only impact that user, not other users, and can’t be used to decide other users’ disputes. If a court determines that this “No class actions” clause isn’t enforceable or valid, then this “Dispute Resolution” section will be invalid and void, but the rest of the Terms will still apply.

10.2 Changes

Notwithstanding the “Updating these Terms” section below, if WiFi Mentor modifies this “Dispute Resolution” section after the date you agreed to these Terms, you may reject any such modification by providing WiFi Mentor written notice of such rejection by email to: info@wifimentor.com.br, within 30 days of the date such modification became effective, as indicated by the “last updated on” language above. To be effective, the notice must include your full name and clearly indicate your intent to reject changes to this “Dispute Resolution” section. By rejecting changes, you agree that you will arbitrate any dispute between you and WiFi Mentor under the provisions of this “Dispute Resolution” section as of the date you last indicated acceptance to these Terms.

11. Updating These Terms

From time to time, we may modernize these Terms to explain our practices or to consider new or different practices (adding new features, for example), and WiFi Mentor reserves the right in its sole discretion to modify these Terms at any time. If we make any material change, we will notify you using noticeable means such as by email notification sent to the email address defined in your account or by posting a notice through our Services. Modifications will become effective on the day they are posted unless stated differently.

Your continued use of our Services after changes become effective shall mean that you accept those changes. Any updated Terms shall replace all prior Terms.
